Code of Ethics and Conduct

This document is about how we behave and what we consider to be right or wrong.

WHAT IS IT?

As a responsible member of society, it is incumbent upon each of us to strive towards excellence in our personal and professional lives. In order to achieve this goal, it is necessary to abide by certain standards of behavior that serve to promote the well-being of oneself as well as others. It is with this in mind that we present the Code of Ethics and Conduct, a set of guidelines that will help to ensure that all members of our organization are acting with integrity and in accordance with our shared values.

By following these principles, we affirm our commitment to honesty, respect, responsibility, and excellence, and demonstrate our desire to create a harmonious and productive environment for all members of our team. We encourage all members to take this code seriously and to hold themselves and each other accountable for upholding its principles.

Preamble

The Gcon4 Code of Ethics and Conduct is fundamental to the values of Gcon4 Spain SL and essential to achieving its mission by promoting the highest standards of ethics, education, and professional excellence for the ultimate benefit of society. Gcon4 works diligently to take measures to minimize our environmental impact and to conduct business to the highest ethical standards, which are critical to maintaining the public’s trust in consultancy companies, their products, and services. This code promotes the integrity of all people working at Gcon4 SL. Permanent and non-permanent staff and owners (for easy reference throughout this code “staff”), regardless of the job functions, cultural differences, or local laws must abide by this code. Violations may result in disciplinary sanctions by Gcon4.

We consider it appropriate to make reference to the fact that in case of conflict between internal GCON4 instructions/procedures and the Code of Ethics and Conduct, the law will prevail.

Respect for human rights

GCON4 is committed to respecting human dignity and human rights, all staff shall respect international standards on fundamental rights and freedoms and in particular the Universal Declaration of Human Rights and the Tripartite Declaration of the International Labour Organisation.
Forced, child, or coerced labor, as well as all forms of modern slavery and human trafficking, shall not be permitted under any circumstances. This applies not only to GCON4 but also to the conduct of and towards our business partners and major suppliers.

Confidentiality

GCON4 possesses and has access to confidential business information of clients or third parties of great importance for its business activity. Unauthorized disclosure of this information may result in heavy losses for GCON4 and may entail labor, civil, and even criminal consequences for the employee who disclosed the information.

In this regard, GCON4 has both technical and organizational measures in place to ensure the protection of the confidential information of both its clients and the organization itself.

GCON4’s internal information shall be treated as confidential and proprietary. Staff shall take appropriate measures to protect the confidential information of GCON4, even after the contractual relationship with GCON4 has ended. Likewise, no irregular access to or disclosure of any confidential or proprietary information of GCON4 or third parties shall be permitted.

Under no circumstances may confidential information, be used for private or third-party benefit.
If there is any doubt about the nature of the information, it must be considered confidential.

Integrity

We always conduct our own services honestly and honorably and expect our clients and suppliers to do the same. Our advice, strategic assistance, and the methods imparted through our training take proper account of ethical considerations, together with the protection and enhancement of the moral position of our clients and suppliers.

Gcon4 staff is prohibited from receiving, offering, promising, authorizing, directing, or making any bribes, kickbacks, or any improper payment to obtain business or any other advantage for the company.

GCON4 maintains a commitment to zero tolerance against bribery and corruption.

Any entity or a third party acting for or on behalf of GCON4 undertakes to maintain ethical behavior in all their business operations and to implement appropriate controls to ensure the actions of the third party will not adversely affect GCON4.

GCON4 prohibits any kind of Facilitation payments and will comply with the applicable regulations on the sponsorship and financing of political parties.

Duty of care

Our actions and advice will always conform to relevant law, and we believe that all businesses and organizations, including Gcon4´s consultancy, software development and maintenance services, should avoid causing any adverse effect on the human rights of people in the organizations we deal with, the local and wider environments, and the well-being of society at large.

Conflict of interest

A conflict of interest is not always clear-cut and easy to recognize, and it can innocently arise. In the event of a possible conflict of interest, whether actual, potential or apparent, the staff will refrain from influencing or intervening in the decision-making process in which they have a direct or indirect personal interest.

All GCON4 staff must disclose to their manager or to the CEO and these disclosures should be submitted for resolution.

Respect of Law

Gcon4 SL expects its staff to comply with the law and this code, and report known or potential violations using the available reporting channels. Gcon4 commits rigorously to observing

applicable competition laws of all countries and organizations and will not tolerate any form of fraud, bribery, or corruption.

Gcon4 will ensure that its business does not use forced labor, human trafficking, slavery, or psychological or physical coercion, and will respect always the labor, social, and regulations of the countries we operate.

Quality assurance

The quality of our service and the value of our support provide the only true basis for continuity. We always try to meet our clients’ contractual requirements, particularly in situations where an external funding provider requires more official parameters and controls. Our contracts will usually be in the form of a detailed proposal, including aims, activities, costs, timescales, and deliverables

Fees

Our fees are always competitive for what we provide, which is high-quality, tailored, specialized service. As such we do not generally offer arbitrary discounts; generally, a reduction in price is only enabled by reducing the level or extent of services to be delivered. That said, we always try to propose solutions that accommodate our clients’ available budgets and timescales. Wherever possible we agree on our fees and basis of charges clearly in advance so that we and our clients can plan reliably for what lies ahead, and how it is to be achieved and financially justified.

Payment

We aim to be as flexible as possible in the way that our services are charged. Some clients prefer fixed project fees; others are happier with time and material projects, and we try to fit in with what will be best for the client. We make no attempt to charge interest on late payments, so we expect payments to be made when agreed.

Data Protection & Privacy

Staff will respect the right to privacy of their staff. Staff will ensure respect for the duty of secrecy and the privacy of employees and third parties.

The applicable regulations regarding the Protection of Personal Data will be complied with at all times. GCON4 guarantees that the processing of personal data will be carried out in strict compliance with European and national laws and regulations related to the protection of personal data.

In particular, GCON4 will only process personal data for legitimate purposes, duly communicated in good time to the interested parties to whom the personal data belongs. Unless expressly authorized, the personal data collected may not be processed for purposes other than those originally agreed upon.

Prevention of Money Laundering and Terrorist Financing

GCON4 is committed to the fight against money laundering and the financing of terrorism, complying with the regulations that are applicable to it in the matter and also avoiding any conduct that could be related to money laundering or the financing of terrorism, as well as any other criminal activity.
Personnel undertakes to avoid conduct that may promote money laundering or terrorist financing.

Intellectual property and moral rights

We retain the moral rights in, and ownership of, all intellectual property that we create unless agreed otherwise in advance with our clients. In return, we respect the moral and intellectual copyright vested in our client’s intellectual property.

Staff will not use elements of intellectual or industrial property of others without the possession of the corresponding license or authorization of its owner.

Professional Conduct

We conduct all of our activities professionally and with integrity. We take great care to be completely objective in our judgment and any recommendations that we give so that issues are never influenced by anything other than the best and proper interests of our clients.

Environment

GCON4 and all its staff will ensure respect for and conservation of the environment in the development of their professional activity.

In particular, all staff will know and comply with the regulations and good environmental practices, striving to minimize the environmental impact generated by their activities.

We always strive to be fair and objective in our advice and actions, and we are never influenced in our decisions, actions, or recommendations by issues of gender, race, creed, color, age, or personal disability.
